Terms of Service
These terms are an agreement between you and [Company legal name] ("we", "us") for your use of GetNixa: the website, web app, desktop apps and editor plugins (the "Service"). By creating an account or using the Service, you agree to them. If you use the Service for a company, you confirm you may accept these terms on its behalf.
1. The Service
GetNixa turns speech in your videos into captions you can style, edit and export. It also offers AI tools such as translation, masking (captions behind a person), audio cleaning and Auto edit. We keep improving the Service and may change or remove features. If we remove something important from a paid plan during a period you've paid for, we'll tell you in advance.
2. Your account
- You must be 18 or older, or use the Service with a parent's or guardian's consent.
- Give accurate details and keep your sign-in secure. You are responsible for everything done through your account.
- One person per account. Team members need their own seats on a plan that includes them.
3. Plans, billing and renewals
- Plans, prices and limits are shown on the pricing page. Prices are in Indian Rupees and include GST unless stated.
- Paid plans are subscriptions that renew automatically, monthly or yearly, until you cancel. You can cancel any time in the app. Your plan stays active until the end of the period you've paid for.
- Monthly limits (caption minutes, translation, masking, Auto edits and so on) reset each billing month. Unused amounts do not carry over.
- If a payment fails, we may move you to the Free plan. Content above the Free plan's limits may then be deleted after 30 days' notice.
- We will give at least 30 days' notice of a price change, and it applies from your next renewal.
- Refunds follow our Refund and Cancellation Policy.
4. Your content
- You own the videos, audio, images, fonts and text you upload and the exports you make ("Your Content").
- You give us a limited permission to store, copy and process Your Content only to run the Service for you. This permission ends when you delete it, apart from backups that expire on their normal schedule.
- We do not use Your Content to train AI models, and we do not claim any ownership of it.
- You confirm that you have the rights to everything you upload, including music, footage, people's likeness, logos and fonts, and that using it with the Service breaks no law or anyone else's rights.
5. Fair and acceptable use
You agree to follow our Acceptable Use Policy. Limits marked "unlimited" or very large are for normal use by one creator or team, not automated bulk processing or resale.
6. AI output
Transcripts, translations, masks and Auto edits are made by AI and can contain mistakes. Please review your captions before you publish. You are responsible for what you publish.
7. Our property
The Service, its software, templates, designs, the GetNixa name and logo belong to us or our licensors. Exports you make with our templates are yours to use, commercially too. You may not resell our templates as templates, copy the Service, or reverse engineer it except where the law allows.
8. Availability
We work hard to keep the Service running, but it may sometimes be unavailable for maintenance, updates or reasons outside our control. We are not liable for losses caused by downtime. Keep your own copies of important files.
9. Suspension and ending
You can stop using the Service and delete your account at any time. We may suspend or end accounts that break these terms or the law, or put the Service or other users at risk. Where reasonable, we'll warn you first and give you a chance to download your content.
10. Disclaimers and limit of liability
The Service is provided "as is". To the extent the law allows, we give no warranties beyond those in these terms. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim. We are not liable for indirect losses such as lost profits, lost followers or lost data. Nothing in these terms limits rights you have as a consumer under Indian law.
11. Indemnity
You agree to cover us against claims caused by Your Content or by your breaking these terms or the law.
12. Governing law and disputes
Indian law governs these terms. Courts in Mohali, Punjab, India have jurisdiction. Before going to court, please contact us so we can try to resolve the issue within 30 days.
13. Changes
We may update these terms. For material changes we'll give at least 15 days' notice by email or in the app. Continuing to use the Service after that means you accept the new terms.
